Thank you for choosing our website, hunedoaraebike.ro, to rent electric bikes and explore the scenic trails of the Hunedoara region. This website is owned and operated by Nomadic Spirit SRL (hereinafter referred to as "Nomadic Spirit", "the company", "the website", "we" or "the organization") – a company registered in Romania, based in Hunedoara, Jud. Hunedoara, Ion Creanga 6/19, registered at the Trade Register under number [J...], with fiscal code [CUI...], email: contact@hunedoaraebike.ro.
By continuing to use this website, you declare that you have read, understood, and agree to these Terms and Conditions. If you do not agree with them, please do not use the services offered by hunedoaraebike.ro.
Please read this document carefully, as it contains essential information about your rights and obligations as a client, the booking process, equipment usage conditions, payment and return policies, and the company's liability limitations.
Conditions of Use and Client Responsibilities
To access the services of hunedoaraebike.ro, users must first accept these Terms and Conditions. A contractual relationship between the company and the client is established only upon acceptance of these conditions and booking confirmation. Bookings can currently be made by phone or email, and you will be asked to provide the following information:

The client is obligated to provide accurate, complete, and up-to-date information. Any changes must be communicated immediately. The company reserves the right to refuse service in the case of incomplete or incorrect data.
Equipment Handover and Return
1. Handover
Payment can be made online (by bank card) or at handover (by card or cash).
A security deposit of 200 RON per bike is blocked on the card and fully refunded upon return if the equipment is in good condition.
2. Return
Bikes and accessories must be returned to the location agreed upon at booking and in the same condition in which they were handed over, except for normal wear and tear.
Delays over 15 minutes will incur a 50 RON/hour additional fee.
If the bike is not returned within 5 hours after the agreed time (without notification), this will be considered theft and reported to the authorities.
3. Inspection
At handover and return, the client and the Nomadic Spirit SRL representative will sign a Handover/Return Report documenting the equipment condition. Any damage will be assessed and charged according to the maintenance and repair price list.
External Factors and Service Limitations
Our services may be affected by external factors such as: mobile network instability, weak GPS signal, weather conditions, maintenance work, technical issues, or administrative decisions. Nomadic Spirit SRL is not liable for service interruptions caused by these situations.
Unacceptable Behavior
Rental may be refused if the client or anyone in their group behaves inappropriately. This includes using the equipment for purposes other than leisure; being under the influence of alcohol or drugs; failing to follow traffic rules; or any other behavior deemed unacceptable at the discretion of E-Bike Rental staff.
We strongly recommend wearing the included safety helmet. While not eliminating all risks, it significantly enhances personal safety. The user accepts that Nomadic Spirit SRL cannot be held liable for injuries resulting from not wearing protective equipment.
Prices and Payment
Payment can be made in cash at bike handover or by card.
Standard rates:

4 hours: 150 RON / person
-
1 full day: 200 RON / person
Extra hours are charged at 50 RON/hour, starting with a delay of more than 15 minutes.
The company reserves the right to adjust prices based on the season, economic context, or special offers. Current prices can be checked on the website or by phone.
Security Deposit
Bike rentals are secured by a credit card. A deposit or card pre-authorization is applied under certain conditions. Pre-authorization is not a payment, but a hold on funds until the bike is returned. Upon rental completion, the hold is automatically cancelled.
In the case of a deposit, the amount is transferred and fully refunded if the returned equipment is in good working condition and shows no signs of damage. If damage, loss, or theft occurs, part or all of the deposit may be withheld to cover costs.
Rental Period
A bike is considered rented once the client has confirmed the reservation (by phone or email), made the payment, and received the equipment. Return is made to the previously agreed location, at which point the rental contract is considered completed. The client must return the bike and accessories in the same condition in which they were received.
Client Obligations and Prohibited Actions
1. Obligations

Must be at least 18 years old; minors only with legal guardian and adult supervision

Must comply with road and mountain rules; ride responsibly

Must use the equipment according to technical specifications and user manual

Must immediately notify Nomadic Spirit SRL and the authorities in case of accident, theft, or malfunction

Must return equipment on time and in original condition

Must report any fines, sanctions, or changes in contact details/documents within 48 hours

Bikes may only be used within Hunedoara County and returned to the location agreed upon during reservation

Must compensate the company for any damages, repair costs, or recovery actions
2. Prohibited Actions
The client is strictly prohibited from:

Using the bike under the influence of alcohol (0.0 ‰) or drugs

Allowing third parties to use the bike without written consent from Nomadic Spirit SRL

Using the equipment for commercial purposes (e.g., deliveries, paid transport, lessons)
-
Carrying large, dangerous, or non-approved items
-
Modifying, disassembling, or repairing the bike
-
Performing stunts, towing, or abusive use
-
Using distracting devices (phones, headphones) while riding
-
Exceeding the maximum allowed weight (100 kg)

Parking in unauthorized or private areas
Note: Wearing a helmet is mandatory for safety. Nomadic Spirit SRL is not liable for injuries resulting from failure to wear it.
Force Majeure and Service Limitations
The company is not liable for service interruptions or degradation caused by:

Mobile network or GPS signal instability

Extreme weather conditions
-
Hardware/software maintenance
-
Administrative decisions or force majeure events
Liability Limitations
Nomadic Spirit SRL, its website, and collaborators do not provide explicit or implicit guarantees regarding:

Uninterrupted website operation

Information accuracy
-
Equipment availability
We are not responsible for:

Software errors, server failures

Direct or indirect damages, including loss of profit, reputation, or data
The user is responsible for any damage caused to the company or third parties due to the violation of legal or contractual obligations and will cover all associated costs (including taxes, penalties, legal fees, etc.).
The client is liable for any damage, theft, loss, or defect caused to the equipment, as well as for damages caused to third parties. In such cases, the company has the right to recover the full loss, including through legal action or by transferring the claim to third-party debt collection agencies.
By using our services or signing the Rental Contract, the client assumes full responsibility for all associated risks, including but not limited to:

Risks related to the use of bikes and equipment

Incorrect use of services or information

Violation of this contract or applicable laws

Failure to use protective equipment (including helmets)

Use of services in poor health, weather, or terrain conditions
The client waives any claims or complaints against Nomadic Spirit SRL and its partners, even if informed in advance of potential damages.
Dispute Resolution
Any disputes arising from or related to these Terms and Conditions or the Rental Contract shall first be attempted to be resolved amicably. If no agreement is reached, the dispute will be referred to the competent courts in Hunedoara County, Romania.
